Introductionmbcd0d091a5fb5dd0_1528450127855_0Introduction

Culture, art, entertainment, science, education and many other fields use the creations of human mind (the so‑called intangible goods).Nowadays, with the domination of the information society, many areas of life are partially or completely based on the use of such goods. In order to protect intellectual property, state governments introduce regulations for the protection of the authors of intangible goods.

Procedurembcd0d091a5fb5dd0_1528446435040_0Procedure

The protection of intellectual property includes several categories of the so‑called intangible goods:

– works,
– data bases,
– patents, utility models and industrial designs, trademarks,
– maps and cartographic resources.

In Poland, actsactacts are a basic source of lawlawlaw. There are several actsactacts that regulate the protection of intellectual property.

Economic rightseconomic rightsEconomic rights are rights to obtain benefits from the sales of the work and the conditions of its distribution. They usually expire after a defined period.

The actactact on the protection of copyrightcopyrightcopyright also details the related rights, whose aim is to protect the interests of the entities taking part in the distribution of works.

The copyrightcopyrightcopyright defines a range of legal permissions to use copyrightedcopyrightcopyrighted works. They include: permitted public use, permitted private use, the right to quotequotequote or the right to reprint. A particular case of permitted public use is permitted educational use.

The conditions of using internet resources

The majority of the content of websites is copyrightedcopyrightcopyrighted. The placement of a given material on the internet does not mean that it can be freely used because it is not a public property but the private property of its author. These materials are copyrightedcopyrightcopyrighted regardless of whether he or she has given his/her name, initials or a nickname. Moreover, the work does not need to be marked with the © sign. The conditions of using the content of somebody’s website are detailed in the licence which should be placed on the portal. If the website does not contain such terms of use, in order to make use of the portal content, one must contact the author of the work to negotiate the conditions of its use.
