CopyrightcopyrightCopyright defines under what conditions you can use works created by other people. Poland is a member state of the World Intellectual Property Organization (WIPO) and has ratified the WIPO Copyright Treaty (WCT), launched in 1996. The European Union has its own directive concerning the protection of copyright. In Poland, the LawlawLaw on Copyrights and Related Rights is in force, which was decreed on 4 February 1994 by the Polish Parliament.

The copyright specifies a range of legal permissions to use copyrighted works. They include: permitted public use, permitted private use, the right to quote or the right to reprint. A particular case of permitted public use is permitted educational use.

Permitted private use:

In accordance with the binding law, in Poland a free use of a work without permission is allowed for private use. Therefore downloading music files, books or films for this purpose is not penalised, as opposed to distributing them. Permitted private use is not applicable to computer software.In the case of computer software, the scope of copyright is limited and permitted private use does not apply. Software providers usually cooperate with external organizations in order to limit piracy and protect their rights more easily. The world’s biggest organization of this type is Business Software Alliance, which also operates in Poland. It promotes and enforces the legitimate use of computer software provided by its members.A person who infringes the copyright may face criminal and civil liability. Criminal liability is defined in the penal code. The aim of civil liability is to ensure compensation to people whose rights were impaired.The public domain is part of creative works that can be used freely since the economic rights of their authors do not apply to them.
